Sales and Delivery Terms EU

1.     Validity

These terms and conditions apply to all sales and deliveries from AB Dogman (”Dogman”).

2.     Payment and prices

2.1

The products are delivered according to the price list at the time ofpurchase. All prices are excl. VAT.

2.2

Prepayment applies to all orders before deliver.

3.     Delivery

3.1

Normally delivery is effected within 3-5 business days. For largercampaigns and for major public holidays, delivery time may be up to7 working days or more.

3.2

Delivery is made according to the rules for international transportdefined by Incoterms 2020: EXW - Ex Works.

3.3

Minimum order value for delivery is 500 Euro ex VAT.

4.     Order procedures

4.1

Orders must be submitted via Dogman’s webshop, mail, phone or fax.

4.2

Order confirmation will be sent by e-mail, following agreement withDogman Customer Service. A binding agreement requires that an orderconfirmation has been given in this way.

4.3

After the order is registered, the picking note is printed at the ware-house, which means that additional orders can no longer be added tothis specific order. Information about the status of specific orders isprovided by the order office by telephone.

4.4

Information about whether the product is in stock or is sold out canbe obtained by logging in to Dogman’s webshop or by phone. Please notethat an item temporarily out of stock is not on back order. This means thatthe product must be ordered again to the applicable delivery terms.

4.5

Spare parts are provided as procurement. For more information andpossible orders, contact Dogman customer service.

5.     Freight charges

5.1

All freights are booked and paid by the customer.

6.     Pallets and packaging

6.1

Normally delivery takes places on EUR-pallets.

6.2

The customer should handle wrapping and packaging himself.These may not be returned.

7.     Complaints

7.1

Goods received must without delay be carefully examined for anydelivery of the wrong goods, the wrong quantity or the transactionaldefects in the goods (hereinafter collectively referred to as ”Error”).

7.2

Errors that can be detected by careful examination (without theneed fo consumer packaging) must be advertised immediately but notlater than 5 days after delivery. Errors that can not be detected by suchexamination shall be advertised within 6 months of delivery, respectively,if delivery relates to dog/cat food, within shorter 3 months after deliveryor within the specified best before period. Except in the event of grossnegligence, Dogman is not responsible for any errors that are claimed afterthe expiry of the aforementioned deadlines.

7.3

All claims must be handled in accordance with the instructions on ourclaim form for return shipping or through Dogman Customer Service. The claim form is available under the Reseller tab at www.dogman.com. Dogman is not responsible for complaints that are handled differently than mentioned above.

8.     Responsibility for Errors

8.1

Dogman is not responsible for errors caused by improper handling,storage, transportation, maintenance or use of the product. As regardsliability for a product to have certain characteristics or to be used for ageneral or particular purpose, Dogman is only responsible to the extentthat Dogman himself, prior to the agreement with the customer, hasexpressly and in writing confirmed that the product has these propertiesor can be used in this way.

8.2

Fault, in order to entitle the customer to a complaint, is to be provenby the customer in a satisfactory manner for Dogman. In case of a justifiedclaim, Dogman has the right to choose whether the defect is to be correc-ted by delivery of a new product or by withdrawal of the purchase to berefunded. Goods that are returned shall be packed well and returned toDogman’s warehouse in Åstorp. For the refund of returned goods, theyare required to be undamaged, in undamaged original packaging and in amarketable condition. No labels may be affixed to the original packaging.

8.3

If Dogman does not deliver (if Dogman has chosen a replacement)new faultless goods within a reasonable period of time, the customeris entitled to cancel the purchase and demand compensation for theadditional cost of any covering purchase.

9.     Valid for all returns

9.1

Return shipping note shall be used for all returns. Contact DogmanCustomer Service.

9.2

The goods are returned well cleaned, well packaged and preferablyin their original packaging.

9.3

For the refund of returned goods, they are required to be undamaged,in unbroken original packaging and in a sellable condition. No labels maybe affixed to the original packaging.

9.4

If the item is not approved, shipping and return shipping will becharged

10.     Generally

10.1

Dogman reserves for possible errors in article information as well asfor out-of-stock items.

10.2

Dogman’s liability for defects in a product or otherwise in connectionwith the delivery of a product is, in any event, and in exception of grossnegligence, limited to the higher of any insurance coverage or 5 timesthe price of the item in question.

10.3

Dogman reserves the right to change prices without prior notice.

11.     Disputes and applicable law

Disputes arising from the contractual relationship regarding the purchaseand delivery of the products shall be referred to the public court with theHelsingborg District Court as the first instance. In the contractual relation-ship, Swedish material law shall apply (Law (1987: 822) on internationalpurchases shall not apply).
